Dear Mr. Chinh Nguyen
1. Annual Payment Information—our records show that you have an outstanding balance. Currently, your annual payment is $1,825 per year. Payment for your 2nd year of your three-year contract is currently due for the amount of $1,825 and we have yet to receive this payment.
After several futile attempts at collecting payment from DeNailSpa.com Inc., Tommy Web Designs is giving final notice before we commence legal proceedings.
You have until Friday of next week to make full payment. If payment is not made by noon central time (1 p.m. eastern time) on Friday, Nov 18, 2011, we will commence legal proceedings.
It is our legal counsel’s strong opinion that you have breached our contract and will be held liable by the Arizona civil courts for the full amount owed plus late fees, as outlined in the contract. The work was done to the satisfaction of Tommy Pham, who had apparent authority over the project; he is willing to testify on Tommy’s Web Design’s behalf. Moreover, you will likely be held liable for all attorney fees because we will assert in our filing that you have engaged in a pattern of fraudulent behavior, in which you enter contracts with vendors, accept delivery of services and then refuse to pay.
We request that you replace this check with a cash or money order payment immediately.
Unless we receive good funds for said amount within 5 days, we will begin appropriate legal action.
If payment $1,825 is not made by noon central time (1 p.m. eastern time. Nov/15/2011)
